Welcome to The Playback Project ("TPP"). These Terms of Service ("Terms") govern your access to and use of our platform, services, and content. By accessing or using TPP, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use our services.

1. Definitions
"Artist" refers to any individual, band, representative, label, or affiliated party submitting music or content to The Playback Project.

"Platform" refers to all digital, broadcast, and operational infrastructure used by TPP.

"Submission" refers to any audio, metadata, images, or media files submitted by the Artist to TPP for potential airplay or promotional use.

"Affiliate Station" refers to any participating radio station, broadcast partner, or digital channel authorized to air content curated by TPP.

2. Eligibility & Representation
By submitting content, the Artist represents and warrants that:

• They are at least 18 years old, or have appropriate legal consent.
• They own or control all rights to the submitted materials.
• The content is not subject to dispute, infringement, or third-party restrictions.
• They meet all outlined submission criteria available on the Submission Requirements page.

3. Exclusivity & Submission Windows
Artists agree to a minimum 7-day exclusivity period for radio premiere, during which the submitted track may not be:

• Released on streaming platforms,
• Played by other radio stations,
• Featured in sponsored content elsewhere.

Any violation of this clause may result in removal from the platform without refund.

4. Submission Format & Deadlines
All music must be submitted in the format specified by TPP:

• WAV or high-bitrate MP3 (320kbps minimum),
• Properly tagged metadata (artist name, track title, contact info),
• Radio edit if explicit content is present.

Deadlines for scheduled runs must be met 10 business days before airplay begins. TPP reserves the right to delay or deny submissions that do not meet technical or timing requirements.

5. Service Scope & Disclaimer
TPP is a curated broadcast service. Artist payments contribute to platform access, promotional packaging, data integration, tracking tools, and administrative costs. Payment does not guarantee radio airplay, inclusion in permanent rotation, or any specific number of spins.

6. Fees, Payments & Refunds
All payments are final and non-refundable. TPP reserves the right to adjust pricing tiers at any time. Refunds will only be issued at the sole discretion of TPP leadership in cases of error, administrative failure, or force majeure.

7. Platform Rights & Publicity
By participating, the Artist grants TPP the right to:

• Broadcast submitted material during scheduled promotional blocks,
• Feature Artist’s name, likeness, and logo in promotional materials,
• Mention Artist across affiliated social media and digital channels.

This does not constitute a transfer of ownership or copyright.

8. Conduct, Behavior & Community Standards
TPP reserves the right to deny or revoke access to the platform due to:

• Misconduct or behavior deemed harmful to the reputation of the platform,
• Participation in hate speech, discriminatory acts, or defamatory actions,
• Association with public controversies that conflict with TPP’s mission.

TPP may remove any artist at any time, for any reason, disclosed or undisclosed.

9. Legal Compliance & FCC Disclosures
All TPP-broadcast content is accompanied by on-air disclosure as required by FCC regulations, such as:

“This segment is sponsored by The Playback Project and features content funded by participating artists.”

10. Waiver of Liability
TPP is not responsible for:

• Loss of digital files,
• Miscommunication or missed airplay due to artist error,
• Station schedule changes,
• Technical errors beyond TPP’s control.

11. Indemnification
Artist agrees to indemnify, defend, and hold harmless TPP, its affiliates, employees, partners, and station contacts from any claims, damages, or liabilities arising out of:

• Submitted content,
• Breach of these Terms,
• Any third-party claims involving infringement or misconduct.

12. Termination
TPP reserves the right to terminate this agreement at any time. The Artist may also voluntarily withdraw, but forfeits access and associated benefits without refund.

13. Governing Law & Dispute Resolution
These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas. Any disputes arising hereunder shall be resolved through binding arbitration in Dallas County, Texas.

14. Changes to These Terms
TPP may modify these Terms at any time. Updates will be posted on the website and, where feasible, sent via email. Continued use of the platform constitutes acceptance of any revisions.
